The Role of Soft Law in the European Union Law

Summary
Soft law originates in the international public law and has been used in the European Union for a long time, however, the popularity of soft law has boomed within the last twenty years. On the one hand, soft law appears very clear – these are non-compulsory and non-binding law instruments, whereas on the other – it is a multidimensional legal phenomenon that can have a significant impact upon the legal systems of European Union and national levels. Despite their popularity, they are associated with a significant weakening of democracy, transparency, and the rule of law in the European Union.
