Summary
A claim for recovery of lost profits involves an analysis of various complex legal and economic considerations. On 28 September 2023, the Supreme Court of the Republic of Latvia adopted judgment № SKC-368/2023. The judgment provided an extended analysis of a claim for recovery of lost profits against a member of the board. The author of the current article analyses both the conclusions expressed in the judgment and numerous additional considerations that should be taken into account in claims for recovery of lost profits against a member of the board.
