Summary
Providing higher education is a task of the state administration that can also be delegated to private universities on the basis of administrative acts. It should be considered that in the administrative procedure in court the defendant should be the private university itself.
Obtaining higher education is a specific administrative procedure, because during the acquisition of higher education, the student simultaneously is subordinated to the university and the subject of a public law contract, creating a dualism in the legal relationship between the university and the student. This causes issues in determining whether the decision taken by the university can be assessed as an independent administrative act or as a decision related to the public law contract.
