Legal Dimension of Court Digitalisation and Workload Management

Summary
Judicial systems are digitalised and empowered by court management tools. However, the investment in this regard does not actually have a proportional impact on efficiency and quality of justice. Legal dimension of digitalization and workload assessment constitute a significant element for court management, that should be taken into account. Digitalisation of courts and proceedings, as well as assessment of court performance indicators are a legal project, rather than a managerial or technological one. Thus, in order to ensure a sustainable result, it must be implemented with full respect of independence, taking into account the synergy between law and technology, in light of procedural aspects and constitutional constraints.
