Improvements of the Regulation of Public Procurement in the Context of Rectification of the Tender

Summary
Directive 2014/24/EU was adopted in 2014 as an attempt to modernise procurement and make it more efficient, improve the access of SMEs to public contracts, and facilitate other aims. In this article, the author analyses the regulation of rectification of a tender, as well as one of the new mechanisms of Directive 2014/24/EU – the European Single Procurement Document (ESPD) and explores its interaction forms with the insti­tute of rectification of a tender. It is concluded that the rectification regulation has not changed in essence and previous case law is applicable. However, there are several aspects that could be improved in national regulation, as well as regarding ESPD, as some questions are raised about practical application.
