Legal Standing for Collective Redress Before Administrative Courts

Summary
Traditionally, the role of administrative courts has focused on the settlement of individual disputes between private individuals and the state in the field of public administration of public law. However, in recent decades, the protection of collective interests and the procedural mechanisms for their protection have become increasingly important. Although this mechanism is more specific to civil proceedings, it is worth discussing it also in the context of administrative court proceedings.
Firstly, the article provides a general overview of the collective redress mechanism and legal standing under it. Secondly, the article analyses the judgment of the Senate of 17 August 2022 in Case № SKA297/2022, in which the Senate, although it did not recognise legal standing for collective redress, provided a number of important insights into the mechanism for the protection of collective interests in administrative proceedings before a court.
