The article explores the type of division outlined in Paragraph 5 of the first part of Section 1075 of the Civil Code, specifically addressing the division of shared immovable property into separate residential properties. It delves into the rationale behind introducing this division form and outlines the conditions for its implementation. Drawing parallels between the division into residential properties and divisions into actual shares (as per Paragraph 1 of the first part of Section 1075 of the Civil Code), the article aims to offer solutions to various challenges associated with this new division format.
