The Phenomenon of Overcriminalization and Its Influence on Development of Latvian Criminal Law

Summary
Applying comparative scientific research method, the author uncovers the nature of the phenomenon of the overcriminalization. He argues that it encompasses criminalization of insufficiently harmful deeds, which can be prevented by less punitive and more economical means. It is a phenomenon of modern society, as it manifests itself in the flood of legal norms from the criminal law perspective. The side effects of overcriminalization are related to injustice, violating of human dignity, degradation of criminal law, overloading of criminal justice system, and potential arbitrariness of law enforcement authorities applying the criminal procedure law. The Latvian Criminal Code in general does not suffer from this legal trend, but there are several examples where it can be seen in different ways.
