Vacatio Legis in the Democratic State Governed by Law

Summary
Vacatio legis is a requirement of the principle of the rule of law, legal security, and legal certainty in a democratic state governed by law. It formulates the obligation of the legislator to provide a sufficient period of time between the publication of a new normative act and its entry into force. It allows the addressees of the legal act the time necessary to familiarize themselves with the content of the new legal regulation and to adjust their activities accordingly.
The problem with vacatio legis still has not been addressed in the Latvian legal system. On the other hand, the constitutional courts of Poland, Estonia, and Lithuania have developed a rich practice regarding the implementation of vacatio legis. In the Latvian legal system, the most important decision on this issue was the judgment of the plenary session of the Senate of Latvia on 25 February 1927.
