Past Lessons and Current Trends of Quasi-Delict Regulation in Latvia

Summary
The article is dedicated to the institute of quasi-delict, which is still preserved as one of the bases for the emergence of obligations in the civil law regulation and the Civil Law.
For the successful application of the quasi-delict institute, it is important to correctly determine the basis of the quasi-delict liability. Likewise, it is crucial to accurately determine the scope of the quasi-delict liability.
Regarding the basis of quasi-delict liability, the understanding of the manifestations of wrongful acts, the place, as well as the culpability, remains unchanged. However, the position regarding the scope of quasi-delict liability must be altered. Narrow, grammatical interpretation of Articles 2358–2362 is not justified, and, in the case of a quasi-delict, only damages for pecuniary losses should be applied as civil remedies.
Since in the case of a quasi-delict the same civil remedies as in the case of a delict (tort) would be applicable, including compensation for non-pecuniary loss, editorial improvements are required in Articles CL 2358–2362 accordingly.
