The Concept of the Function of Legal Syllogism

Summary
There are several different kinds of legal syllogisms. One way to differentiate between them is by their function. The aim of this paper is to show the categories that constitute the concept of the function of legal syllogism. The author concludes that it is useful to think about the function of the legal syllogism in terms of two categories: the intended scope of the legal syllogism in relation to the whole legal justification, and the proposition that the legal syllogism is used to justify with logical necessity.
