Summary
The rules on the termination of the joint property should be sufficiently clearly enshrined in the legal framework to ensure that each co-owner is able to ascertain the civil procedural steps to be taken to terminate the joint property. The current civil procedural legal framework is incomplete. The Civil Law of the Republic of Latvia determines that each joint owner may at any time require a division of joint property. However, the Civil Procedure Law of the Republic of Latvia does not regulate the procedure for submitting a claim for division of joint property ownership. The aim of the current study is to examine the scope of civil proceedings for division of joint property ownership, ascertain the limits of the claim, to explore how the concept of actio duplex works, and to establish the options available for court in solving the case.
