Summary
According to Article 383 of the Civil Law of Latvia, inheritance is a legal entity, it can acquire rights and undertake obligations. The inheritance becomes a legal entity upon death of the estate leaver, and continues to exist as a legal entity until heirs accept the inheritance. During its existence, the estate may participate in various legal relations and take part in proceedings. However, in some cases the question of the scope of the legal personality of the estate has arisen. This article offers discussion as to whether the inheritance can be deemed a “classical” legal entity, or rather a legal entity with limited legal authority and capacity. The authors analyse the issues regarding representation of the estate, particularly addressing certain aspects of the custodian’s responsibility under the planned amendments to the Inheritance Rights Section of the Civil Law.
