Summary
The article focuses on the principle of consensuality in the teaching of Professor Carl Eduard Erdmann from the University of Tartu, in light of a loan pre-agreement. The issue is examined by providing an insight into the classification of contracts in Baltic private law, the personality of C. Erdmann and his views as a person and a scholar. The article reveals the reasons that prompted C. Erdmann, contrary to the position of local law, to express a controversial opinion on the right to claim the conclusion of a loan contract on the basis of a preliminary contract. The article concludes with a brief overview of developments in Germany, Estonia and the DCFR.
