Termination of Professional Service Contract by Agreement of Parties Before End of Term: Imperative Military Interests of State versus Human Rights

Summary
The purpose of the article is twofold: to analyse the specifics of the termination of professional service contract before the end of the term; and to find out whether such basis as the legislator’s political decision to limit the fundamental rights defined in Article 106 of the Constitution is justified, due to state’s imperative military interests. The author concludes that an unjustified refusal of the institution to agree on the termination of the professional service contract before the end of the term does not comply with the principle of proportionality and thereby can be recognized as an unjustifiable violation of the Article 106.
