Summary
Effective enforcement of court judgments is an essential part of the right to a fair trial. The regulation of enforcement by criminal-law means of coercive measures is outdated. The means of coercive measures include liquidation, which is carried out by declaring insolvency proceedings. The author analyses the suitability of the insolvency proceedings as an enforcement mechanism for achieving such purposes.
