The Role of State’s Due Diligence in Assessing Legality of Actual Conduct

Summary
This article examines the relevance of the insufficiency of the legal norms regulating actual conduct in the Latvian normative framework, as well as the possibility to apply other legal tools available in the Latvian legal system to assess the legality of actual conduct, the precise limits of which are not defined in the law. The author proposes a method of determining the legality of actual conduct by applying and modifying the principles of unlawful conduct found in the Civil Law.
