Status and Representation of Government Institution in Court

Summary
The article addresses the status and representation of a government institution in both administrative and civil procedure in Latvia, offering a conclusion that in the civil procedure an unnecessary formalism is being upheld by the Supreme Court regarding the representation of not only government institutions but also private legal entities. The requirement to complete the representation with “documents certifying the official’s right to represent the legal entity without special authorization” set forth in the second part of Article 85 of the CPL means submitting and requesting such documents only when the submission of such documents is necessary to confirm the status of the relevant person. Submission of such documents is not necessary in cases where the status of the relevant official can be ascertained in public registers available to the court, as well as in relation to officials of a public person whose right of representation derives from an external regulatory act.
